The ioncube_encoder strips off the top line of php cli files so that it has to be added back after encoding, which is kind of a pain. It would be nifty if the encoder could leave the line intact so the file doesn't have to be edited. It should be very easy to do

#!/usr/local/bin/php.cgi -q
<?
?>

In fact it does if the shell is called php, and you can also use the --shell-script-line option to specify an alternative path if required. As your shell isn't called php, use that option and you'll be fine, or rename the shell. See section 2.4.4 in the User Guide PDF.
